These Terms and Conditions (“Terms”) govern your access to and use of our website located at www.homecare-direct.com (the “Site”) and any services, products, or information provided through the Site, including vehicle service contract and extended warranty information (collectively, the “Services”). By using the Site, submitting information, requesting a quote, purchasing a plan, or otherwise interacting with the Services, you agree to be bound by these Terms. If you do not agree, do not use this Site. 1. IMPORTANT NOTICE ABOUT WARRANTIES / SERVICE CONTRACTS Exclusive National Auto Club is not a vehicle manufacturer. Any vehicle service contract or extended warranty offered through this Site is a separate agreement between you and the provider/administrator/obligor identified in your contract. Coverage varies by plan, vehicle, eligibility, and state. Not all plans are available in all states. The official contract controls. Website descriptions are for general informational purposes only. 2. ELIGIBILITY By using this Site, you represent that you: Are at least 18 years old Are legally able to enter into a binding agreement Will provide accurate, truthful information We may refuse service, cancel orders, or deny access at our discretion where permitted by law. 3. SERVICES PROVIDED We may provide: Vehicle service contract information Quote requests and pricing estimates Customer support and plan explanations Enrollment/purchase options Claim assistance guidance (where applicable) We may also work with third-party administrators, obligors, or licensed partners. 4. NO LEGAL OR FINANCIAL ADVICE Information on this Site is provided for general informational purposes only and does not constitute legal, financial, or insurance advice. You should review your contract and consult appropriate professionals if needed. 5. ACCURACY OF INFORMATION We try to ensure the information on this Site is accurate, but we do not guarantee that: Coverage descriptions are complete Pricing shown is final Vehicle eligibility results are error-free Content is always up to date We reserve the right to correct errors, update content, and change offerings at any time. 6. QUOTES, PRICING, AND VEHICLE ELIGIBILITY Quotes are estimates based on the information you provide, including: Vehicle year, make, model Mileage Condition and usage Location/state Coverage level Final pricing and eligibility may require verification. 7. PURCHASES, PAYMENTS, AND BILLING If you purchase a plan through this Site: You agree to provide valid payment information You authorize us and/or our payment processor to charge your payment method Payments may be one-time or recurring depending on plan terms If your payment is declined, your coverage may be delayed, canceled, or not issued. 8. CANCELLATION AND REFUNDS Cancellation and refunds (if any) are governed by the terms in your specific vehicle service contract and applicable state law. CLAIMS Claims are administered by the contract administrator listed in your agreement. We do not guarantee that a claim will be approved. Claim approval depends on: Coverage terms Maintenance requirements Cause of failure Pre-existing conditions Contract exclusions Proper authorization procedures Always follow the claims process in your contract. 10. MAINTENANCE REQUIREMENTS Many plans require you to maintain your vehicle according to manufacturer guidelines and keep records. Failure to maintain your vehicle or provide documentation may result in claim denial. 11. COMMUNICATIONS, CALLS, AND TEXT MESSAGES (TCPA) By providing your phone number, you consent to receive communications from us and our partners, which may include: Calls (including automated or prerecorded) Text messages (SMS/MMS) Emails These communications may relate to quotes, customer service, plan details, billing, and marketing. Consent is not a condition of purchase. Message and data rates may apply. You may opt out at any time by replying STOP to a text message or contacting us directly. 12. USER CONDUCT You agree not to: Use the Site for unlawful purposes Submit false or misleading information Attempt to hack, disrupt, or overload the Site Use bots, scrapers, or automated tools without permission Interfere with other users’ access We may suspend or block access for violations. 13. INTELLECTUAL PROPERTY All content on the Site, including logos, designs, text, graphics, and software, is owned by Exclusive National Auto Club or licensed to us and protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, or exploit any content without written permission. 14. THIRD-PARTY LINKS AND SERVICES The Site may include links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of third parties. 15. DISCLAIMER OF WARRANTIES THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted access, error-free operation, or that the Site will be free of viruses or harmful components. 16. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW, Exclusive National Auto Club SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Some states do not allow certain limitations, so parts of this section may not apply to you. 17. INDEMNIFICATION You agree to defend, indemnify, and hold harmless Exclusive National Auto Club, its officers, employees, contractors, affiliates, and partners from any claims, liabilities, damages, losses, and expenses arising from: Your use of the Site Your violation of these Terms Your violation of any rights of a third party 18. PRIVACY Your use of the Site is also governed by our Privacy Policy and California Privacy Policy, which are incorporated into these Terms. 19. CHANGES TO THESE TERMS We may update these Terms at any time. Updates will be posted on this page with a new “Last Updated” date. Your continued use of the Site after changes means you accept the updated Terms. 20. GOVERNING LAW These Terms shall be governed by the laws of the State of New Jersey, without regard to conflict of law principles. 21. DISPUTE RESOLUTION At our discretion, disputes may be resolved by: Informal resolution first Binding arbitration Small claims court (if applicable) If you want, I can add a full arbitration clause with a class-action waiver (common for warranty sites). 22. SEVERABILITY If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. 23. ENTIRE AGREEMENT These Terms, along with any posted policies, form the entire agreement between you and Exclusive National Auto Club regarding the Site.
